Welcome to Galerie Veyne.
These Terms & Conditions (“Terms”) govern your access to and use of the Galerie Veyne website, including any artwork, products, services, artist submissions, purchases, communications, and transactions conducted through or in connection with the website.
By accessing or using the website, submitting artwork, creating an account, placing an order, or otherwise interacting with Galerie Veyne, you acknowledge that you have read, understood, and agree to be bound by these Terms.
If you do not agree to these Terms, you must not use the website or purchase products through Galerie Veyne.
For purposes of these Terms, “Galerie Veyne,” “we,” “us,” and “our” include Galerie Veyne and, where applicable, its owners, members, managers, officers, employees, contractors, agents, representatives, affiliates, successors, assigns, licensors, and service providers.
1. ABOUT GALERIE VEYNE
Galerie Veyne is an independent online art gallery and curator presenting artwork created by independent artists and photographers.
Artwork may include original works, limited editions, open editions, prints, framed works, photographs, paintings, drawings, sculpture, mixed-media works, and other forms of artistic expression.
Galerie Veyne may curate, represent, market, promote, sell, license, distribute, or otherwise facilitate the sale of artwork created by third-party artists.
Unless expressly stated otherwise in writing, Galerie Veyne is not the original creator of artwork offered by independent artists.
2. ELIGIBILITY AND USE OF THE WEBSITE
You represent that you are legally capable of entering into a binding agreement.
You agree to use this website only for lawful purposes and in accordance with these Terms.
You may not:

Use the website for unlawful, fraudulent, abusive, or deceptive purposes;

Attempt to interfere with the website or its security;

Access areas or information that you are not authorized to access;

Copy, reproduce, distribute, modify, or commercially exploit website content without permission;

Scrape, harvest, or systematically collect information from the website;

Impersonate another person or entity;

Submit false, misleading, infringing, or unauthorized information or artwork; or
-
Engage in conduct that could reasonably harm Galerie Veyne, its artists, customers, service providers, or reputation.
Galerie Veyne reserves the right to restrict, suspend, or terminate access to the website or any portion thereof at any time, with or without notice, where reasonably necessary to protect Galerie Veyne or others.
3. ARTWORK INFORMATION
We make reasonable efforts to present artwork accurately.
However, artwork images displayed online may vary from the physical artwork because of screen settings, lighting, photography, image compression, color calibration, printing processes, or other technical or environmental factors.
Minor variations in color, texture, finish, dimensions, framing, materials, or appearance that do not materially alter the artwork do not constitute defects.
Artwork descriptions, dimensions, materials, edition information, artist biographies, and other information may be supplied by artists or third parties.
Although Galerie Veyne makes reasonable efforts to review information presented on the website, we do not guarantee that every description or representation is complete, current, or error-free.
If a material error is discovered, Galerie Veyne reserves the right to correct the error and, where appropriate, cancel or decline an affected order.
4. PRICES
Prices are displayed in U.S. dollars unless otherwise stated.
Galerie Veyne reserves the right to change prices at any time before an order is accepted.
We may correct pricing, typographical, product-description, availability, or other errors at any time.
If an order is affected by a material pricing or listing error, Galerie Veyne may cancel the order and refund any amount actually paid for the affected order, except where applicable law requires otherwise.
A displayed price does not necessarily constitute an offer to sell. An order becomes binding on Galerie Veyne only after it has been accepted and confirmed by us.
5. ORDERS AND ACCEPTANCE
Submitting an order constitutes an offer to purchase the selected artwork.
Galerie Veyne reserves the right to accept, decline, limit, or cancel any order for any lawful reason, including:

Artwork availability;

Pricing or listing errors;

Suspected fraud or unauthorized activity;

Payment problems;
-
Shipping limitations;
-
Artist or supplier availability;
-
Inventory discrepancies; or
-
Other circumstances affecting fulfillment.
If Galerie Veyne cancels an order after payment has been received, the customer's remedy will generally be limited to a refund of the amount actually paid for the canceled order, except where applicable law requires otherwise.
6. PAYMENT
Orders must be paid using an accepted payment method.
Payment processing may be performed by third-party payment processors.
Galerie Veyne does not generally store complete payment-card information.
You represent that you are authorized to use the payment method submitted for your purchase.
You agree not to initiate fraudulent, unauthorized, or improper payment reversals, chargebacks, or disputes.
If you believe a transaction was made in error, you agree to contact Galerie Veyne first and provide a reasonable opportunity to investigate and resolve the issue.
Nothing in these Terms limits rights that cannot legally be waived.
7. ORIGINAL ARTWORK
Original artwork may be unique and may therefore have no replacement inventory.
Once an original work has been sold, Galerie Veyne may be unable to provide an identical replacement.
Original artwork may also have characteristics inherent to handmade or physical works, including variations in texture, surface, materials, aging, or finish.
Such characteristics do not necessarily constitute defects.
Additional conditions applicable to a particular original work may be stated on the individual product page.
8. PRINTS AND MADE-TO-ORDER PRODUCTS
Certain products may be printed, framed, or produced after an order is placed.
Made-to-order products may have different processing times than ready-to-ship artwork.
Minor variations arising from printing, framing, mounting, paper, canvas, materials, or production processes may occur.
Where a product is custom-made or produced specifically for an order, returns may be limited as described in our Shipping & Returns Policy and to the extent permitted by applicable law.
9. SHIPPING AND DELIVERY
Shipping estimates are estimates only and are not guaranteed delivery dates unless expressly stated otherwise in writing.
Galerie Veyne may use independent shipping, printing, framing, fulfillment, and logistics providers.
Once an order has been transferred to a carrier, delivery may be affected by circumstances outside Galerie Veyne's reasonable control.
These circumstances may include carrier delays, weather, customs, natural disasters, transportation disruptions, incorrect addresses, customer unavailability, government actions, or other events beyond our reasonable control.
Customers are responsible for providing accurate shipping information.

10. RETURNS AND REFUNDS
Returns, exchanges, cancellations, and refunds are governed by our Shipping & Returns Policy, as supplemented by these Terms.
Certain artwork may be non-returnable because of its nature, including certain made-to-order, custom, personalized, or otherwise specially produced items.
Nothing in these Terms eliminates any rights or remedies that cannot lawfully be excluded.
11. COPYRIGHT AND INTELLECTUAL PROPERTY
All website content owned or licensed by Galerie Veyne—including text, logos, branding, graphics, photographs, website design, layouts, and other materials—is protected by applicable intellectual-property laws.
Artwork displayed through Galerie Veyne remains protected by copyright and other applicable intellectual-property rights.
Unless expressly authorized in writing, purchasing an artwork does not transfer copyright or reproduction rights to the purchaser.
Unless expressly stated otherwise, customers may not:

Reproduce artwork;

Scan or digitally reproduce artwork for commercial purposes;

Create merchandise from artwork;
-
Distribute digital copies;
-
Sell reproductions;
-
Use artwork commercially;
-
Remove copyright or attribution information; or
-
Otherwise exploit artwork beyond ordinary personal ownership and display.
All rights not expressly granted are reserved by the applicable rights holder.
12. ARTIST CONTENT AND REPRESENTATIONS
Artists and other individuals submitting materials to Galerie Veyne are solely responsible for ensuring that they have the legal right to submit those materials.
By submitting artwork, photographs, biographies, statements, images, or other materials, the submitter represents and warrants that:

They own the necessary rights or have obtained all necessary permissions;

Their submission does not knowingly infringe another person's intellectual-property rights;
-
Their submission does not knowingly violate another person's privacy, publicity, or other legal rights;
-
They have obtained all releases, permissions, licenses, or consents reasonably necessary for the intended use of the submitted materials;
-
Information provided to Galerie Veyne is accurate to the best of their knowledge;
-
They will promptly notify Galerie Veyne of any material dispute concerning submitted artwork or rights; and
-
The submitted artwork complies with all applicable laws and regulations.
Galerie Veyne reserves the right to reject, remove, suspend, or discontinue consideration of any submission or artwork.
Additional provisions governing artists are contained in the Artist Submission Terms.
13. NUDITY, FIGURATIVE WORK, AND DEPICTED PERSONS
Galerie Veyne may present and sell legitimate fine-art works depicting the human form, including nude and partially nude subjects.
Galerie Veyne's acceptance of figurative or nude artwork is conditioned upon compliance with applicable law and Galerie Veyne's submission requirements.
As a condition of submitting any artwork depicting a person in a nude, partially nude, or sexually suggestive manner, the submitting artist represents and warrants that:

Every identifiable person depicted in the artwork was at least eighteen (18) years of age at the time the artwork was created or the depiction was made.

The artist has obtained all permissions, consents, licenses, and releases reasonably necessary to create, reproduce, display, market, distribute, and sell the artwork and to permit Galerie Veyne to exercise the rights granted to it.

The artwork does not depict a minor in nude, sexually explicit, or otherwise prohibited circumstances.
-
The artist has not knowingly submitted artwork that violates applicable laws concerning child sexual exploitation, obscenity, non-consensual imagery, privacy, publicity rights, or other applicable restrictions.

Upon request, the artist will provide Galerie Veyne with documentation reasonably sufficient to establish the age of depicted persons and the artist's authority to submit and commercially exploit the artwork.

The artist will immediately notify Galerie Veyne if any person depicted in submitted or accepted artwork disputes the artist's authority to use, display, reproduce, market, or sell the work.
Galerie Veyne may require additional documentation, verification, releases, identification of models, or other evidence before accepting, displaying, marketing, or selling any work.
Galerie Veyne reserves the right, in its sole discretion and to the maximum extent permitted by law, to reject, remove, restrict, suspend, or discontinue any artwork that Galerie Veyne believes may create legal, reputational, platform, payment-processing, advertising, shipping, or other risk.
Galerie Veyne may also remove or decline artwork for aesthetic, curatorial, commercial, reputational, or operational reasons, regardless of whether the artwork is otherwise lawful.
Acceptance, publication, promotion, or sale of an artwork by Galerie Veyne does not constitute a representation or warranty by Galerie Veyne that the artwork complies with every law, regulation, third-party right, platform requirement, or other legal requirement applicable to the artist, model, artwork, or transaction.
The submitting artist remains solely responsible for the legality of submitted artwork and for obtaining, maintaining, and producing all necessary rights, releases, permissions, age documentation, and other supporting records.
The artist's representations, warranties, indemnification obligations, and responsibilities relating to depicted persons and submitted artwork survive rejection, removal, sale, termination of any relationship with Galerie Veyne, and expiration or termination of these Terms.
14. USER CONTENT
If you voluntarily submit reviews, comments, testimonials, photographs, messages, suggestions, or other content to Galerie Veyne, you represent that you have the right to provide that content.
To the extent permitted by law, you grant Galerie Veyne a non-exclusive, worldwide, royalty-free license to use, reproduce, display, publish, modify, distribute, and otherwise use such content for legitimate business, marketing, promotional, archival, and operational purposes.
Galerie Veyne is not obligated to publish or retain user-submitted content.
We reserve the right to remove content that we reasonably believe violates these Terms, applicable law, or the rights of others.
15. THIRD-PARTY SERVICES
Galerie Veyne may rely upon third-party companies for website hosting, payment processing, shipping, printing, framing, fulfillment, analytics, communications, marketing, and other business functions.
These third parties operate independently and may have their own terms and policies.
To the maximum extent permitted by law, Galerie Veyne is not responsible for independent acts, omissions, failures, delays, outages, errors, or policies of third-party service providers.
16. AVAILABILITY OF THE WEBSITE
We attempt to keep the website available and functioning properly, but we do not guarantee uninterrupted or error-free operation.
The website may occasionally be unavailable because of maintenance, updates, technical problems, hosting issues, security incidents, third-party outages, or other circumstances.
Galerie Veyne reserves the right to modify, suspend, discontinue, or restrict any portion of the website at any time.
17. NO WARRANTY
To the maximum extent permitted by applicable law, the website and its content are provided on an “as available” and “as is” basis.
Galerie Veyne disclaims warranties to the maximum extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, except where such warranties cannot legally be excluded.
Galerie Veyne does not warrant that:

The website will be error-free;

Information will always be current or complete;

Artwork will meet subjective expectations;

Third-party services will operate without interruption; or

The website will be free from viruses or other harmful components.
Nothing in these Terms excludes a warranty or legal protection that cannot lawfully be excluded.
18. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, Galerie Veyne and its owners, members, managers, officers, directors, employees, contractors, agents, representatives, affiliates, successors, assigns, licensors, service providers, and other associated persons or entities shall not be liable for indirect, incidental, consequential, special, exemplary, punitive, or similar damages arising from or relating to:

Inability to use the website;

Purchase or attempted purchase of artwork;

Artwork or product characteristics;

Shipping or delivery delays;
-
Third-party services;
-
Website interruptions;

Unauthorized access;

Errors or omissions;

Loss of data;

Loss of profits;

Loss of business opportunities; or
-
Any other matter arising from or relating to the website, artwork, services, or these Terms,
except to the extent such limitation is prohibited by applicable law.
To the maximum extent permitted by law, the aggregate liability of Galerie Veyne and the protected parties identified above arising out of or relating to a particular transaction or claim shall not exceed the amount actually paid by the claimant to Galerie Veyne for the specific product or service giving rise to the claim.
19. INDEMNIFICATION
To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Galerie Veyne and its owners, members, managers, officers, directors, employees, contractors, agents, representatives, affiliates, licensors, service providers, successors, and assigns (collectively, the “Galerie Veyne Parties”) from and against any and all claims, demands, actions, proceedings, liabilities, damages, judgments, losses, costs, expenses, and reasonable attorneys' fees arising out of or relating to:

Your use or misuse of the website;

Your violation of these Terms;

Your violation of applicable law;

Your submitted content;

Your artwork or other materials;

Your alleged infringement or violation of another person's rights;

Your breach of any representation or warranty;

Your fraudulent, negligent, reckless, or wrongful conduct;

Your purchase or use of artwork;

Any dispute between you and an artist, customer, carrier, payment provider, or other third party arising from your conduct; or
-
Any claim resulting from information or materials you provide to Galerie Veyne.
Without limiting the foregoing, any artist submitting artwork agrees to defend, indemnify, and hold harmless the Galerie Veyne Parties from claims arising from or relating to:

Ownership or authorship of submitted artwork;

Copyright or trademark disputes;
-
Alleged infringement;
-
Model or subject claims;
-
Lack of model releases or permissions;
-
Age or identity of depicted persons;
-
Privacy or publicity claims;
-
Allegedly unauthorized commercial use;
-
Claims that submitted artwork violates applicable law; or
-
Any breach of the artist's representations or warranties.
This indemnification obligation applies to claims brought directly against Galerie Veyne or any Galerie Veyne Party.
Galerie Veyne reserves the right, at its own expense, to assume exclusive control and defense of any matter otherwise subject to indemnification, and you agree to reasonably cooperate with that defense.
You may not settle any claim affecting the rights, reputation, liability, or interests of a Galerie Veyne Party without our prior written consent.
20. RELEASE
To the maximum extent permitted by law, you release and discharge the Galerie Veyne Parties from claims arising from matters for which you have assumed responsibility under these Terms, including claims relating to third-party artists, third-party service providers, shipping providers, payment processors, and other independent third parties, except to the extent caused by conduct for which such release is legally prohibited.
21. FORCE MAJEURE
Galerie Veyne shall not be liable for delay or failure to perform caused by circumstances beyond its reasonable control.
Such circumstances may include natural disasters, severe weather, war, terrorism, civil unrest, governmental actions, labor disruptions, transportation failures, supply-chain disruptions, internet or telecommunications failures, cyber incidents, utility failures, pandemics, epidemics, shortages, or failures of third-party service providers.
Where such circumstances occur, Galerie Veyne may delay, modify, suspend, or cancel affected services or orders as reasonably necessary.
22. DISPUTES AND GOVERNING LAW
These Terms shall be governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles, except to the extent applicable law requires otherwise.
To the extent permitted by applicable law, any legal action arising out of or relating to these Terms or the relationship between you and Galerie Veyne shall be brought in a court of competent jurisdiction located in Virginia.
You consent to the jurisdiction and venue of such courts to the extent legally permitted.
Before initiating formal litigation, the parties agree to make a good-faith effort to resolve the dispute informally by contacting Galerie Veyne and allowing a reasonable opportunity for resolution.
Nothing in this section prevents either party from seeking emergency injunctive or equitable relief where appropriate.
23. NO CLASS ACTIONS
To the maximum extent permitted by applicable law, you agree that any dispute between you and Galerie Veyne will be resolved on an individual basis and not as part of a class, collective, consolidated, or representative action.
You waive any right to participate as a class representative or class member in any class proceeding against Galerie Veyne or the Galerie Veyne Parties, except where such waiver is prohibited by law.
24. SEVERABILITY
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision shall be enforced to the maximum extent permitted by law and the remaining provisions shall remain in full force and effect.
The invalidity of one provision shall not invalidate the remainder of these Terms.
25. WAIVER
Failure by Galerie Veyne to enforce any provision of these Terms shall not constitute a waiver of its right to enforce that provision later.
No waiver shall be effective unless expressly made in writing by an authorized representative of Galerie Veyne.
26. ASSIGNMENT
You may not assign or transfer your rights or obligations under these Terms without the prior written consent of Galerie Veyne.
Galerie Veyne may assign, transfer, delegate, or otherwise restructure its rights and obligations under these Terms in connection with a sale, merger, acquisition, reorganization, transfer of assets, corporate restructuring, or other business transaction.
27. CHANGES TO THESE TERMS
Galerie Veyne may modify these Terms from time to time.
Updated Terms will be posted on this website with a revised “Last Updated” date.
Your continued use of the website after revised Terms are posted constitutes acceptance of the revised Terms to the extent permitted by law.
Terms applicable to a completed purchase will generally be those in effect at the time the applicable order was accepted, unless otherwise required by law.
28. ENTIRE AGREEMENT
These Terms, together with the Privacy Policy, Shipping & Returns Policy, Artist Submission Terms, and any other policies expressly incorporated into these Terms, constitute the agreement governing your use of the website and your relationship with Galerie Veyne concerning the applicable subject matter.
If there is a conflict between these Terms and a specific written agreement entered into between Galerie Veyne and a customer or artist, the specific written agreement will control to the extent of the conflict.
